The Albright factors are the legal standard Mississippi courts use to determine child custody in the best interests of the child. The chancellor weighs factors including: the parent-child relationship, each parent's character and fitness, each parent's ability to provide care, the stability of home environments, school and community ties, health and education needs, and, if the child is 12 or older, the child's preference. No single factor is decisive; the chancellor balances all facts to reach a custody decision.
Children 12 years of age or older may express a preference in Mississippi custody cases, but their preference is only one factor among the Albright factors, it is not binding on the chancellor. The court still weighs all circumstances, including the child's stability, school ties, both parents' fitness and resources, and what serves the child's best interests. Very young children cannot express a legal preference.
A Guardian ad Litem (GAL) is a neutral professional appointed by the Jones County Chancery Court to investigate the custody dispute and advocate for the child's best interests.
